Terms and Conditions

KANE WW Property Solutions Limited ("Kane WW Property Solutions" "KWW", "we", "us") website(s) (our "Site" or "Sites") and related services are provided to you in accordance with the following Terms and Conditions.

KANE WW Property Solutions Limited is a limited liability company registered in England and Wales No. 15501299, our registered office is 124 City Road, London, EC1V 2NX. We are registered with the Information Commissioner’s Office under the Reference Number ZB664102.

Introduction

We have experience of dealing with landlords and the procedure involved and share general information regarding tenancy deposit disputes, provide document(s) preparation services, assist in tenancy dispute and making non-reserved communications with (but not limited to) landlord, managing agent, authorised schemes.    

Usage

Kane WW Property Solutions is not a law firm is not a law firm and does not provide Legal Advice. WE are not regulated by the SRA. Your use of any KWW's Services does not create a solicitor-client relationship between you and KWW. 

 

Product and/or Services

We provide document(s) preparation services, assist in tenancy dispute and making non-reserved communications with (but not limited to) landlord, managing agent, authorised schemes. The services are based on the data you have personally provided into our relevant forms. We will be able to modify the document(s) according to your scenario as discussed. In all circumstances, it is your responsibility to ensure you enter the correct information into the forms as it may cause delays later and additional fees if your documents need to be amended.

We do not give legal advice regarding your documents or any aspect of your case and you proceed on that basis. 

Non-Legal Advice

You agree that Kane WW Property Solutions does not provide Legal Advice. If you receive any communication from KWW, its officers, directors, employees, successors, agents, subsidiaries, partners, contractors, vendors, manufacturers, distributors, representatives and affiliate, which is Legal Advice, you agree that it is NOT a communication authorized by KWW and you agree to immediately delete and disregard it.

Here is an non-exhaustive list of Legal Advice:-

  • any legal related communication, work or service which, under the governing law of your jurisdiction, is only allowed to be performed by or under the supervision of a properly licensed lawyer or attorney;

  • any reserved legal activities as defined in the Legal Services Act 2007.

  • any legal activities that can only be carried out by regulated professionals.

The information and opinions we provide only gives general guidance on the law do and are for informational purposes only. They do not constitute any form of legal advice and should not be relied upon or treated as a substitute for specific advice relevant to particular circumstances and is not intended to be relied upon by you in making (or refraining from making) any specific decisions. If there are any legal problem(s), you should take appropriate professional legal advice from a qualified solicitor before taking or refraining from taking any action(s). 

Customer Information

Customers should always check that all information they provide is correct before proceeding to payment. We do not check this information for you. You should also check all details on the template document(s) are correct, including any assumptions that may have been made on your behalf. Failure to do so may lead to your document(s) being invalid or an increase in cost. 

Payment

In a card transaction, you must use your own card. KANE WW Property Solutions will not be liable for any debit and/or credit card fraud. The liability to use a card fraudulently will be on the user and the onus to 'prove otherwise' shall be exclusively on the user.

 

In a bank, AliPay or any other transfer transactions, KANE WW Property Solutions will not take any responsibility if you transferred money to the wrong bank account. If you receive email from us requesting that you send money to another account, please contact us at kanewwpropertysolutions@gmail.com immediately.

Cancellations and Refunds

Any documents or products intended by Kane WW Property Solutions solely for consumer use are refundable. Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 (the “Regulations”), you are entitled to cancel your order and terminate this contract within fourteen days of submitting it. Cancellations/Refunds will incur a fee of £20. This charge covers our merchant charges (both on the purchase and the refund) and other incidental expenses.

 

However, if the document has been prepared and sent to the landlord/managing agent/authorised schemes, regardless of service and/or receipt, your ability to cancel the order and apply to refund will be limited. If you wish to cancel your order, you must notify us by e-mail at: kanewwpropertysolutions@gmail.com

 

If you sent an email notice under this sub-section and receive a machine-generated message that delivery has failed, for that notice to be valid the sender must no later than ten business days after sending the email message deliver a tangible copy of that notice with end-to-end tracking and all fees prepaid.

Complaints

Kane WW Property Solutions are committed to providing quality service and information. If at any point you are dissatisfied with the service we provide to you, we aim to respond to complaints within 10 working days.

Copyright & Licence

The purchase of a product(s) gives the Customer a licence to use the documents and legal information contained therein subject to limitations described in these terms and conditions.

All the forms and resulting documents are and remain the copyright of Kane WW Property Solutions.

Customers may not re-sell, re-publish, copy or distribute any Kane WW Property Solutions document or any part thereof for use by any third party, including another organisation within a group.

Kane WW Property Solutions reserves the right to withdraw (without refund) access to any product where it is believed (solely by KWW) 

Kane WW Property Solutions will not issue any refunds either in full or in part where access to any product is withdrawn due to a breach or suspected breach of these Terms & Conditions by the Customer.

Referrals

Where Kane WW Property Solutions refers a client to or recommends an individual lawyer, law firm or barristers' chambers the client's contractual relationship is strictly with the individual lawyer, law firm or barristers' chambers - not Kane WW Property Solutions. If a client is dissatisfied with the service provided by an individual lawyer, law firm or barristers' chambers the client should contact the individual lawyer, law firm or barristers' chambers to seek a resolution to the dispute and should follow the dispute resolution procedures provided by the individual lawyer, law firm or barristers' chambers.

We may share your contact and purchase information with the referred individual lawyer, law firm or barristers' chambers, and they will become your primary point of contact for client care, billing enquiries, and any other matters related to your dispute. The referred individual lawyer, law firm or barristers' chambers will pay us a fee as compensation for our referral services. Once the dispute is resolved, our involvement in this matter concludes. 

Liability

Kane WW Property Solutions shall accept no responsibility for any errors, omissions or misleading statements on this website, or for any loss which may arise from reliance on materials contained on this website. Certain parts of this site may link to external Internet sites, and other external Internet sites may link to this website. Kane WW Property Solutions is not responsible for the content of any external Internet sites.

As set out in our website terms of use, you agree that under no circumstances will we be held liable for any direct, indirect, incidental or other type loss or injury resulting from your use, or downloading of any content on our site.

Criminal activities carried out by means of computers and the internet are common. You are responsible for preventing unauthorized access to your devices (computers, tablets) and communication channels (e.g., mobile phones), which should only be connected to a secured network or the internet to the extent that is necessary, and only when appropriate security measures (e.g., firewalls and/or network segmentation) are in place. KANE WW Property Solutions cannot and will not accept responsibility for the loss and damages caused as a result of illegal activities perpetrated by criminals. For your own protection, please refer to the advice provided by the National Cyber Security Centre (www.ncsc.gov.uk).  

This website and its attachments may contain viruses that could damage your computer system. While the company has taken reasonable precautions to minimize this risk, we do not accept liability for any damage you may sustain or suffer as a result.

Indemnification

By using this website any other operated by us and any service contained, you agree to indemnify, hold harmless and defend KANE WW Property Solutions, its parent, subsidiaries and affiliates, and their respective officers, directors, employees, successors, agents, subsidiaries, partners, contractors, vendors, manufacturers, distributors, representatives and affiliates from any claims, damages, losses, liabilities, and all costs and expenses of defense, including but not limited to, legal fees, resulting directly or indirectly from a claim (including without limitation, claims made by third parties for infringement of intellectual property rights) by a third party that arises in connection with (i) your use or misuse of the website and any service contained; (ii) your breach of the Terms and Conditions; or (iii) your violation of any law or the rights of a third party. You agree to cooperate as fully as reasonably required in the defense of any claim. KANE WW Property Solutions reserves the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you.

Alterations of Terms and Conditions

Kane WW Property Solutions is free to alter or revise this website and any other website operated by us at any time and without the requirement to notify users.

Severability

The paragraphs, sub-paragraphs and clauses of these Terms & Conditions shall be read and construed independently of each other. Should any part of this agreement or its paragraphs, sub-paragraphs or clauses be found invalid it shall not affect the remaining paragraphs, sub-paragraphs and clauses.

Acceptance

By using this website and any other operated by us and any service contained within constitutes unconditional acceptance to these Terms & Conditions.

You may not use the Site for any purpose that is unlawful or prohibited by these Terms and Conditions, or to solicit the performance of any illegal activity or other activity which infringes the rights of KANE WW Property Solutions or others. Notwithstanding any other rights or restrictions in these Terms and Conditions, you may not use this Site to: (a) transmit via or through the Site any information, data, text, images, files, links, or software except in connection with your authorized use of this Site or otherwise in response to specific requests for information by us; (b) introduce to the Site or any other computer or web site viruses, worms, Trojan horses and/or harmful code; (c) obtain unauthorized access to any computer system; (d) impersonate any other person, including but not limited to, a registered user of this Site or an employee of KWW; (e) invade the privacy or violate any personal or proprietary right (including intellectual property rights) of any person or entity; (f) misrepresent the identity of a user or use a false e-mail address; (g) tamper with or obtain access to this Site or any component of this Site; (h) conduct fraudulent activities; or (i) collect or harvest information regarding other users of the Site for any reason whatsoever, including, without limitation, for sending such users unsolicited commercial e-mail.

Charges

Payment of the Bill is required within 14 days. You are responsible to pay a default fee to KANE WW Property Solutions at the rate of 3% per annum above the Bank of England base rate (as amended from time to time) on any money remaining unpaid after 14 days from the date of the Bill. We reserve all rights to serve a statutory demand at all times.

 

You are responsible to pay to Kane WW Property Solutions all reasonable costs and expenses incurred by us in:

  • recovering or attempting to recover any unpaid monies

  • the enforcement of such unpaid monies

  • service of any notice relating to the breach of this terms and conditions regardless of whether court proceedings are brought

  • taking legal advice and/or legal action in relation to any breach of this terms and conditions by you.

 

Wavier

Failure by Kane WW Property Solutions to enforce any accrued rights under these Terms & Conditions is not to be taken as or deemed to be a waiver of those rights unless Kane WW Property Solutions acknowledges the waiver in writing.

Jurisdiction

This website and any others operated by us are intended for the jurisdiction of England & Wales and as such should not be specifically used or relied upon for any other jurisdiction. Kane WW Property Solutions does not accept responsibility for any such use. 

These Terms & Conditions shall be interpreted, construed and enforced in accordance with English law and shall be subject to the exclusive jurisdiction of the English Courts (subject to the paragraph below).

 

In relation to matters regarding the dispute and enforcement of unpaid Bill, Kane WW Property Solutions has the absolute discretion to bring claims under the jurisdiction whereby you, the intended recipient of the Bill is located and/or resident, even if it is outside the jurisdiction of the English Courts. Subject to the compliance of the local laws, all reasonable costs and expenses incurred by Kane WW Property Solutions (e.g. legal fees and disbursements, resulting directly or indirectly from a claim) in enforcing the unpaid bill shall be borne by you entirely.
